Why does the Court and its individual justices vote the way they do at the certiorari




(hereinafter cert) vote? This question has engaged the attention of a host of Supreme




Court scholars. One of the variables identified by these scholars is error-correction.




Baum (1992, p. 104) tells us that the justices “more likely to vote to accept a case when




they disagree with the position of the lower court” than when they agree with that




position.




But not everyone agrees. Stem, Gressman, and Shapiro (1986, p. 22 1) state: to resolve the conflicts among the lower courts and to determine questions of




importance . The Supreme Court’s burden and responsibility are too great to permit




it to review and correct every misstep made by the lower courts in the application




of accepted principles. Hence the Court generally will not grant certiorari just




because the decision below may be erroneous.
